How long do we need to be separated before we file for a divorce?


To request a no-fault divorce in Virginia, the parties must be separated for one year, during which time at least one party intended for the separation to be permanent. However, if the parties have entered into a written separation agreement and there are no children born of the marriage or adopted by the parties, they may file for divorce after only six months of separation.
